General terms and conditions online shop

1. scope

The following General Order Conditions apply to the business relationship between Mittler Report Verlag GmbH and the customer in the version valid at the time of the order. If no special regulations have been made, the general legal provisions apply. Differing conditions from the purchaser are excluded.

2. Conclusion of contract

The “catalogue”/ “online shop” of Mittler Report Verlag GmbH does not yet represent a binding offer. The customer’s order leads to a contract with Mittler Report Verlag GmbH if the latter confirms the order. This is done by sending a separate order confirmation or by delivering the goods. With the acceptance of the contract by Mittler Report Verlag GmbH, a purchase contract is concluded between the customer and Mittler Report Verlag GmbH, on the basis of which Mittler Report Verlag GmbH must provide the customer with ownership of the goods against payment of the purchase price. Mittler Report Verlag GmbH does not recognize any claims beyond this.

3. delivery time

For titles in stock, delivery within Germany will take place within 10 working days (Monday to Friday) of ordering at the latest. Within the EU we deliver within 15 working days at the latest. If a title is no longer available, the purchaser will be notified. Any purchase price or subscription price paid will be refunded immediately.

4. Shipping and payment conditions

Deliveries to PO boxes or mail-stored items are generally not possible.

The purchase price is due upon delivery. Up to an order value of 75.00 euros, the following shipping costs will be charged depending on the weight:

Within the Federal Republic of Germany:

Weight of the ordered goods including packaging

• up to 500 grams: 2.20 euros
• between 501 and 1000 grams: 2.90 euros
• over 1000 grams 3.90 euros

For orders worth more than 75.00 euros, no shipping costs will be charged.

Outside the Federal Republic of Germany:

Weight of the ordered goods including packaging

• up to 500 grams: 3.90 euros
• between 501 and 1000 grams: 7.50 euros
• over 1000 grams 17.00 euros

5. Storage of data and contract content

The customer's personal data and information required for business transactions as well as the order confirmation, which once again reflects the purchase item and the purchase price and thus the essential content of the contract, are stored by Mittler Report Verlag GmbH only for its own use and will not be passed on to third parties.

6. refund policy

Mittler Report Verlag GmbH delivers the ordered goods with the right of return. This right only applies to data storage media (CD-ROMs) that were delivered sealed if they are also returned in a sealed condition. The return can be made within 14 days of receipt of the goods without giving reasons to the following address: Mittler Report Verlag GmbH, Beethovenallee 21, 53173 Bonn. The customer bears the costs for the return if the goods delivered correspond to those ordered. Mittler Report Verlag GmbH can only take back shipments that are sufficiently franked. Please note that Mittler Report Verlag GmbH may, if necessary, claim a reduction in value caused by use.

If the service received by the customer cannot be returned in whole or in part or only in a deteriorated condition, the customer is obliged to pay compensation if necessary. This does not apply if the deterioration of the item is solely due to its inspection - as would have been possible in a shop. Furthermore, the purchaser can avoid the obligation to pay compensation by not using the item as an owner and refraining from anything that would impair its value. The customer bears the costs for the return if the delivered goods correspond to those ordered.

7. Right of withdrawal

The customer has the right to cancel this contract within fourteen days without giving reasons.

The cancellation period is fourteen days from the day on which the customer or a third party named by him who is not the carrier takes possession of the last goods.

In order to exercise his right of withdrawal, the customer must contact us (Mittler Report Verlag GmbH, Beethovenallee 21, D-53173 Bonn, Tel.: 0228/ 3500 870, Fax: 0228/ 3500871; Email: info@mittler-report,de) by means of a clear statement (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract.

In order to meet the cancellation period, it is sufficient for the customer to send notification of the exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation:

If the customer cancels this contract, we will refund to him all payments we have received from him, including delivery costs (except for additional costs arising from choosing a method of delivery other than the cheapest standard delivery offered by us has chosen) immediately and at the latest within fourteen days from the day on which we received notification of the cancellation of this contract. For this repayment we use the same payment method that the customer used in the original transaction, unless something different was expressly agreed with him; under no circumstances will he be charged any fees as a result of this repayment. We can refuse repayment until we have received the goods back or until the customer has provided evidence that he has sent the goods back, whichever is the earlier.

The customer must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which he informed us of the cancellation of this contract. The deadline is met if he sends the goods before the deadline of fourteen days has expired.

The customer bears the costs of returning the goods if the goods delivered correspond to those ordered.

The customer only has to pay for any loss in value of the goods if this loss in value is due to handling other than what is necessary to check the nature, properties and functionality of the goods.

8. Retention of title

The goods remain the property of Mittler Report Verlages GmbH until full payment has been made. Only the first reminder is free. From the second reminder onwards, the customer will incur reminder fees; a third reminder can be issued by a debt collection agency.

9. Place of jurisdiction

Bonn is the exclusive place of jurisdiction for all legal disputes arising from and in connection with this contract.

10. Final provisions

German law applies. The applicability of the UN Convention on Contracts for the International Sale of Goods is excluded.

Should individual provisions of these General Terms and Conditions be or become ineffective, the contract or the other effective provisions of the General Terms and Conditions will not be affected. The ineffective or ineffective regulation will be replaced by the effective regulation that comes closest to the economic meaning and purpose of the ineffective regulation. The same applies to regulatory gaps.
