The Kiel shipyard German Naval Yards (GNYK) makes use of the existing procurement law review option and is against the decision of the Ministry of Defense for the award of Multi-role combat ship MKS 180 Action.

"After careful consideration we have decided to challenge the award decision," said a spokesman for the shipyard. He added: "We have serious doubts about the legality of the decision and therefore all legal possibilities that are available to us to exploit."

Die von GNYK nun vorgebrachte Rüge ist der erste Schritt im Nachprüfungsverfahren. Innerhalb einer Frist (in der Regel sechs bis acht Wochen) ist nun von der Vergabestelle Bundesamt für Ausrüstung, Informationstechnik und Nutzung der Bundeswehr (BAAINBw) der Rüge zu entsprechen. Das Ergebnis kann zu einem Beschwerdeverfahren vor der Vergabekammer genutzt werden.

Vor diesem Hintergrund wird die Absicht des BMVg noch im Frühjahr die parlamentarische Befassung in Form einer 25 Millionen-Euro-Vorlage zu ermöglichen nun zu beurteilen sein.
